Information letter on the collection of personal data in the context of the creation, use and dissemination of photo and film recordings pursuant to Art. 13 GDPR

With the following information, we would like to give you an overview of the processing of your personal data by us and your rights in this regard.

1. Who is responsible for processing my personal data?

HIMA Paul Hildebrandt GmbH, Albert-Bassermann-Straße 28 68782 Brühl, is the data controller with respect to the data specified below. The use of the words “we” or “us” in this document always refers to HIMA Paul Hildebrandt GmbH. We process personal data in accordance with the provisions of the European General Data Protection Regulation (hereinafter referred to as “GDPR”) and the German Federal Data Protection Act (hereinafter referred to as “BDSG”) as well as other data protection requirements that may also be applicable. 2. What are our purposes in processing your personal data and what is the legal basis?

The personal data collected, including audio and video recordings, will be processed for the following purposes:

a. Web-Streaming: Your image, voice, and any contributions made during the event will be live-streamed via online platforms to an audience. The live stream may also be recorded and made available for on-demand viewing at a later time.

b. Marketing Purposes: The recordings, which may include your likeness, and any contributions made during the event, may be used for promotional materials, including but not limited to, social media posts, advertisements, newsletters, and other marketing communications. These materials may be used to promote future events, services, or products related to the event organizer.

The processing of personal data for marketing and web-streaming and marketing purposes is based on your consent pursuant to Art. 6 (1) (a) of the GDPR. Please note that if you choose to turn on your camera, your image will appear in the recording. However, you are not required to have your camera on during the event In addition, the processing of personal data is carried out, among other things, for event planning and organization. This processing is based on our legitimate interest in the smooth running and organization of the event. Art. 6 (1) (f).

3. Who are the recipients/categories of recipients of my personal data?

The personal data, including audio and video recordings, collected during the event will be shared with the following recipients:

  • Internal departments of HIMA Paul Hildebrandt GmbH, including but not limited to marketing, management, and relevant employees. 
  • Commissioned service providers involved in the technical, marketing, or event management processes, are authorized to process the data on our behalf. 
  • Social networks covered by the consent, including Facebook, LinkedIn, YouTube, Twitter, and Instagram, as well as their users.
  • Visitors to the website of HIMA companies, where recordings may be published.
4. Are my personal data transferred to third countries?

A transfer of your personal data to a third country may occur if you consent to the publication of such recordings on social networks, The transfer is necessary for the purpose of sharing the data on platforms such as Facebook, LinkedIn, YouTube, Twitter, and Instagram, which may operate in countries where the level of data protection may not be equivalent to that in the EU. The transfer of data to these platforms is based on your explicit consent, as outlined in Article 49 (1) (a) of the GDPR. By providing your consent, you acknowledge that in certain cases, adequate data protection safeguards as required by EU law may not be in place. 5. How long my personal data will be stored?

Your personal data will be stored only for as long as necessary to fulfill the purposes of processing, as outlined above, and for the duration of your consent. Once the purpose of processing has been achieved or if you withdraw your consent, your data will be securely deleted or anonymized in accordance with the GDPR. It is important to be aware that any information shared on the internet, including audio and video recordings as well as photographs, can be easily copied, redistributed, and permanently archived. Specialized archiving services may document the content of certain websites at specific points in time. As a result, information published online may remain accessible even after it has been deleted from the original source. This means that once your data is shared, you may have limited control over its further dissemination.

6. Can I withdraw my consent in the future?

Insofar as the processing of the data is based on your consent, the consent can be withdrawn at any time by an informal declaration to the controller with effect for the future. The withdrawal of consent has no negative effects for you.

7. Am I obliged to provide my personal data?

The recording of images, videos, web-streaming as well as the provision of your personal data for planning and organization is voluntary. However, please note that your participation may not be possible if you provide incomplete information or no information at all.

8. Does automated decision – making and profiling take place?

Automated decision-making and profiling do not take place.

9. Can I revoke my consent?

The provision, use of your personal data and the consent is voluntary. If it is not given, no disadvantages will arise. This consent can be withdrawn at any time with effect in the future. In the event of consent withdrawal, video and sound recordings and/or photos that essentially only show the data subject shall be removed immediately from the website or the company's presentations and shall no longer be used for new publications or presentations. If the data subject is depicted in film recordings or photos together with other persons, the film recording or photo does not have to be removed, but it is sufficient if the person concerned is immediately made unrecognizable in the video recording or photo (e.g., by pixelation). If the data subject is depicted in the film recording or photo together with other persons and HIMA Paul Hildebrandt GmbH does not wish to use the option of pixelation or if identification (e.g., by sound) of the data subject nonetheless cannot be ruled out, the recording must be removed immediately. You are welcome to turn off your camera at any time during the event, should you prefer.

10. What rights do I have in relation to my personal data?

You can exercise the following rights at any time by contacting our data protection officer:

  • Information about your data stored by us and its processing (Art. 15 GDPR)
  • Rectification of incorrect personal data (Art. 16 GDPR)
  • Deletion of your data stored by us (Art. 17 GDPR)
  • Restriction of data processing, provided that we are not yet allowed to delete your data due to legal obligations (Art. 18 GDPR)
  • Objection to the processing of your data by us (Art. 21 GDPR) and
  • Data portability, provided you have consented to data processing or have concluded a contract with us (Art. 20 GDPR).
Right to object on a case-by-case basis (right to object under Art. 21 GDPR)

You have the right at any time, for reasons that arise from your particular situation to object to the processing of personal data pertaining to you, which occurs pursuant to 6(1)(f) GDPR (data processing on the basis of a balance of interests); this also applies to profiling based on this provision in accordance with Art. 4(4) GDPR.

If you file an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or if the processing is for the purpose of enforcing, carrying out or defending legal claims.
